LiveSwell · Give-back disclosure · Draft v0

Say it exactly — or don't say it

Before LiveSwell says any can funds a cause, the wording has to be specific and checkable. This is the working template. Oregon's rules for this kind of promotion have not been confirmed yet — counsel must review before any public use.

Legal notice

This page is a working draft for internal review. Nothing here is legal advice. TBD: Oregon registration, filing, and reporting requirements for a for-profit that promotes sales as benefiting a charity. Have an Oregon-licensed attorney with alcohol and nonprofit experience review the template once, then treat any edit as a fresh review.

What every campaign should disclose

Five things, stated plainly

  1. 1. The exact dollar amount or percentage per unit donated (e.g. "$0.25 per can" — not "a portion of proceeds").
  2. 2. The full legal name of the recipient nonprofit and its 501(c)(3) status.
  3. 3. The start and end dates of the campaign.
  4. 4. The maximum total donation (cap), if any.
  5. 5. TBD: any Oregon registration or reporting the promotion requires, filed before the campaign begins.

Template · long form

On-pack / point of sale / web page

"From [START DATE] to [END DATE], LiveSwell Brewing Co. will donate $0.25 from each 16oz can of [SKU NAME] sold in Oregon to [NONPROFIT LEGAL NAME], a 501(c)(3) nonprofit organization (EIN [XX-XXXXXXX]), up to a maximum total donation of $[CAP]. No portion of the purchase price is tax-deductible. [REGISTRATION STATEMENT — TBD, if Oregon requires one]"

$0.25 per can is a working planning number, not a commitment.

Do not say

Vague language to avoid

  • ❌ "A portion of proceeds benefits [cause]."
  • ❌ "Support [nonprofit] with every sip."
  • ❌ "Buy a can, plant a tree." (unless the ratio, cap, and dates are stated)
  • ❌ Anything implying the purchase is tax-deductible.
